ETH sitting on a centralized exchange you haven't touched in years? California's new law means the state could eventually take custody of it. Not as a penalty. Not as a seizure. Because your account looks abandoned.
California's SB 822, signed October 14, 2025, and effective January 1, 2026, formally brings cryptocurrency under the state's Unclaimed Property Law for the first time. This guide breaks down how that process works, which accounts are at risk, whether self-custody actually protects you, and what to do right now if any of your holdings have gone idle on an exchange.

What Is an Unclaimed Property Law and Why Does It Apply to Crypto?

Unclaimed Property Laws (UPLs) are state-level statutes with a long history. Long before crypto existed, states required banks and brokerages to transfer dormant accounts to state custody after a period of owner inactivity. The legal mechanism is called escheatment: the custodian reports the idle asset to the state, transfers it, and the state holds it until the rightful owner comes forward.
The concept exists to protect consumers. If a bank quietly pockets unclaimed balances, that's theft. If the state holds them, they stay retrievable.
For decades, California's UPL covered bank accounts, stock certificates, insurance proceeds, and similar intangible property. Crypto occupied a grey zone. As documented in the SB 822 bill text on leginfo.legislature.ca.gov, before 2025, California had zero UPL statutes that explicitly covered digital financial assets. Exchanges operated without clear escheatment obligations, producing inconsistent practices across the industry.
SB 822 closes that gap. The law defines a new category called "digital financial assets" (DFAs) and subjects them to the same UPL framework that already governs a standard bank account. According to the SB 822 statutory text on leginfo.legislature.ca.gov, the DFA definition is deliberately scoped: it excludes SEC-registered securities and certain non-asset digital items, focusing the law on crypto assets like ETH and BTC held in custodial accounts.
The practical meaning: if you hold crypto through an exchange acting as custodian, that exchange is now a "holder" under California law, with formal reporting and transfer obligations attached.

What California's SB 822 Actually Says: Dormancy, Escheatment, and State Custody

The California Governor signed SB 822 on October 14, 2025, according to the official press release from California Senate District 13. The law took effect January 1, 2026.
The bill's most important provision establishes a dormancy period after which an exchange account is legally considered abandoned. Legislative discussions have referenced approximately three years of inactivity as the trigger. The exact statutory language in the SB 822 bill text on leginfo.legislature.ca.gov is the authoritative source. Confirm it before making any compliance decision.
Two design choices distinguish this law from older UPL frameworks:
1. Asset preservation over immediate liquidation. Earlier approaches to crypto escheatment often required immediate conversion to cash. SB 822 moves toward holding digital assets in their original form. According to the California Senate District 13 press release covering the bill signing, SB 822 "modernizes the Unclaimed Property Law to clearly define and protect virtual currencies under state custody and escheat procedures." A designated cryptocurrency custodian, appointed by the California State Controller's Office (SCO), holds the assets rather than liquidating them on receipt.
2. Notice before transfer. Exchanges must attempt to notify account holders before reporting assets as unclaimed. Owners get a window to reactivate their accounts and stop the process before it reaches the state.
Two companion bills, AB 1052 and AB 2335, work alongside SB 822. According to bill materials on leginfo.legislature.ca.gov, these clarify the DFA definition, standardize reporting workflows for exchanges, and address governance details that SB 822 delegates to the California Department of Financial Protection and Innovation (DFPI) and the SCO.

How the Process Works: From Dormant Account to State Controller's Wallet

The SCO's unclaimed property holder reporting guidance on sco.ca.gov outlines the general workflow that SB 822 adapts for digital assets. Here's the full sequence:

Dormancy trigger. Your exchange account shows no owner-initiated activity for the statutory dormancy period — approximately three years per legislative discussion. Passive events like receiving staking rewards or airdrops may not reset the clock if you didn't initiate them.

Due diligence and notice. Before reporting your account, the exchange must attempt to contact you. If your email address on file is outdated, you may never see that notice.

Holder reporting. The exchange files a report with the SCO and transfers your DFA. At this point, the asset leaves the exchange.

State custody. The SCO transfers the asset to its designated cryptocurrency custodian, which holds it in original digital form rather than selling immediately.

Liquidation window. After a further holding period under state custody, the law permits eventual liquidation per ongoing SCO and DFPI guidance. The asset doesn't stay in original form indefinitely.

Owner claim. At any point, the original owner can file a claim with the SCO to recover the crypto or, if already liquidated, its cash value at the time of sale.

The DFPI's role creates a dual-agency compliance environment. According to Assembly Banking and Finance Committee background materials at abnk.assembly.ca.gov, exchanges already licensed under California's broader crypto regulatory framework face layered obligations that intersect with UPL reporting requirements.

Which Other States Have Similar Crypto Escheatment Rules?

California is positioning itself as a regulatory pioneer. The SB 822 framework is among the first in the country to explicitly define digital financial assets within a dedicated UPL structure, rather than forcing crypto into rules written for bank accounts.
That said, California isn't operating in a vacuum. States with robust UPL enforcement programs — including New York, Texas, and Delaware — have applied general unclaimed property statutes to crypto by analogy, even without crypto-specific legislation. The results have been inconsistent: different dormancy periods, different liquidation approaches, different notice standards.
California's explicit DFA framework may become a national template. The AB 1052 exclusion language on leginfo.legislature.ca.gov, which keeps SEC-registered securities out of the DFA definition, signals a careful effort to avoid colliding with federal securities regulation. Any state following California's lead will face the same boundary question.
For now: if you hold crypto on a U.S.-based exchange, assume your state has some version of unclaimed property exposure, even without crypto-specific rules on the books.

What Exchange Users Should Do Right Now to Protect Their Holdings

The dormancy clock is the risk. The simplest way to manage it is to generate owner-initiated activity. According to the SCO's holder reporting guidance on sco.ca.gov, activity definitions typically require an action from the account holder — not passive holding.
Here's a practical checklist:

Log in and transact. A trade, withdrawal, or deposit resets the clock. Even updating verified account settings may qualify, depending on how the exchange interprets owner-initiated activity.

Update your contact information. Exchanges must send notices before escheating assets. An outdated email means you won't receive those warnings.

Audit every exchange account you hold. Many holders have dormant accounts from earlier market cycles. Each carries its own dormancy exposure.

Understand what passive activity doesn't count. Staking reward distributions, airdrop receipts, and auto-compounding yield events are likely not owner-initiated under the law's framework. Don't rely on passive income flows to keep an account active.

Check your exchange's jurisdiction. SB 822 targets custodians operating under California jurisdiction: exchanges headquartered in California, licensed by the DFPI, or primarily serving California users.

The simplest version: if you have no plans to use a specific exchange balance anytime soon, move it somewhere you control — or log in periodically and make a minimal transaction.

Does Self-Custody on a Hardware Wallet or Base Actually Protect You?

Yes, with one important qualification.
Self-custody wallets — hardware wallets like Ledger or Trezor, and software wallets where you hold the private keys — are not custodians under California's UPL framework. The SB 822 holder definitions on leginfo.legislature.ca.gov require a third-party custodial relationship. No third party, no holder. No holder, no escheatment. Self-custody removes you from the law's reach entirely.
The same logic applies to Base, Coinbase's Layer 2 network. Base is a public blockchain. Hold ETH in a self-custodied wallet on Base, control the private keys, and no custodial relationship exists. Escheatment rules don't apply.
The key distinction isn't which chain or network you use. It's whether someone else controls your keys.
If you hold assets through a Coinbase-custodied account that interacts with Base, the custodial relationship still exists. The exchange is still the holder. The law still applies. According to DFA framework scope materials at abnk.assembly.ca.gov, the test is custody — not the technical architecture of the network underneath.

The Trade-Off You Need to Understand

Self-custody eliminates escheatment risk but introduces a different kind: total loss if you lose your seed phrase or private keys. No state database holds your ETH for you to claim later if your hardware wallet is destroyed without a backup.
Neither option is risk-free. What SB 822 changes is this: the choice between exchange custody and self-custody is now a regulatory question as much as a security one.

What Happens If Your Crypto Is Already Escheated — Can You Get It Back?

Yes. Unclaimed property laws are designed for reunification, not permanent state retention.
The California SCO maintains a searchable unclaimed property database. According to the SCO's unclaimed property FAQ on sco.ca.gov, the rightful owner of any escheated asset can file a claim at any time. There's no hard deadline.
Under SB 822's asset-preservation approach, crypto held by the state's designated custodian should initially remain in original digital form. The California Senate District 13 press release on the bill signing specifically highlights asset preservation as a policy goal. Claim your ETH before the state liquidates it and you recover actual ETH.
If the state has already liquidated the asset after the custody holding period, you receive the cash value at the time of liquidation. Not the current price. Not any appreciation since the sale.
This matters more than it might seem. If ETH was escheated and liquidated at $2,000, and you file a claim two years later when ETH trades at $6,000, you receive $2,000 per unit. The claim window stays open. The timing doesn't.
File a claim as soon as you discover an escheated asset. Don't wait.

The Regulatory Clock Is Already Running

California's SB 822 isn't a crypto crackdown. It extends a century-old consumer protection mechanism to a new asset class. The state isn't trying to seize your ETH. It's preventing exchanges from quietly sitting on abandoned assets indefinitely.
That framing doesn't eliminate the practical risk. Leave ETH dormant on a centralized exchange for three years, go silent, and your assets will eventually move to state custody. If they're liquidated before you come back, you won't recover the price gain.
The choice between exchange custody and self-custody has always been a security question. California's SB 822 makes it a regulatory question too. California almost certainly won't be the last state to build this kind of framework. Any holder who understands the dormancy clock, keeps their contact information current, and makes a deliberate custody choice is protected. Bureaucratic inertia only claims the assets of people who stopped paying attention.
