The Digital Asset Market Clarity Act is running out of runway.
Senate Majority Leader John Thune said it on July 23. The landmark crypto market structure bill will likely miss its window before August recess. A fall delay is now on the table. The White House isn&#x27;t ready to accept that.
&quot;I would like to at least get Clarity started. We&#x27;ll see where the votes are,&quot; Thune told <a href="https://www.coindesk.com/policy/2026/07/23/clarity-act-expected-to-miss-its-window-before-congress-summer-break-leadership-says" target="_blank" rel="noopener">CoinDesk</a> on July 23.
That&#x27;s a notable shift. Nine days earlier, Bloomberg Law reported that Thune had affirmed a vote before recess. Now he&#x27;s hedging.
<a href="https://www.thecoinzone.com/news/white-house-considers-crypto-pardons/" data-wpil-monitor-id="2649">White House crypto</a> adviser Patrick Witt pushed back. &quot;There&#x27;s that first week of August that the Senate is in session. I wouldn&#x27;t count it out,&quot; Witt told CoinDesk. He&#x27;s pointing to a narrow window. Lawmakers go dark through early September.
The bill is H.R. 3633. It would establish a formal framework for classifying <a href="https://www.thecoinzone.com/news/hana-standard-chartered-digital-assets-partner/" data-wpil-monitor-id="2650">digital assets</a>. Jurisdiction gets split between the CFTC and the SEC. A Congressional Research Service overview lays it out: digital commodities fall under CFTC oversight. The <a href="https://www.thecoinzone.com/news/sec-defi-guidance-broker-exemption/" data-wpil-monitor-id="2652">SEC</a> retains authority over certain primary market activities. That jurisdictional split has been the central sticking point.
The stakes are real. Ethereum&#x27;s regulatory status has been unresolved since its proof-of-stake transition in 2022. The <a href="https://www.thecoinzone.com/news/sec-cftc-eth-commodity-clarity-act-congress/" data-wpil-monitor-id="2651">SEC</a> under prior leadership never formally classified ETH as a commodity. The <a href="https://www.thecoinzone.com/regulation/clarity-act-stablecoins-eth-defi-explained/" data-wpil-monitor-id="2648">CLARITY Act</a> would fix that statutorily. No enforcement action can replicate that kind of legal certainty.
The bill&#x27;s path hasn&#x27;t been smooth. A Reuters analysis from March 5, 2026, republished via Investing.com, documented an early impasse. Banking sector opposition stalled progress even as the White House pushed for movement. That dynamic has persisted into summer.
DeFi protocols are watching closely. The classification framework carries direct compliance implications. How the act defines digital commodities determines whether decentralized platforms face securities law obligations. <a href="https://www.thecoinzone.com/defi/what-is-matcha-xyz/" data-wpil-monitor-id="2647">Liquidity pools</a>, governance tokens, fee structures. All of it.
The bill misses August recess, the next floor opportunity is September. Or later. The political calendar gets messier from there. Midterm positioning starts. The first week of August may be Congress&#x27;s last clean shot.
Thune&#x27;s hedging. Witt&#x27;s not conceding. Something has to give.
